PRICES
Prices are subject to change without notice. All material listed is subject to stock on hand. Sales tax will be added unless a valid resale card is on file. We reserve the right to size plant material and price it according to actual plant size at time of purchase. (Plant tags are for identification purposes only and do not determine the final selling price). We operate as a wholesale dealer. To purchase at the wholesale level, you must be directly related to the horticulture industry. You should have a nursery dealer’s certificate and a vendor’s license; you may be a municipality, university or government agency. With this definition we hope to protect the business of our customers. It is unacceptable to send retail customers to buy nursery stock through any person entitled to wholesale prices.
NON-WARRANTY
C&M Growers gives no warranty, expressed or implied, as to the variety or productivity of any nursery stock it sells. C&M Growers is not responsible for any delays in shipment of soil or plant material. All estimates of shipments or delivery dates are subject to weather conditions, labor slowdowns and work stoppages, availability of materials, accidents, transportation delays, mechanical breakdowns, acts of God and other causes beyond the reasonable control of Seller.
RETURN POLICY
Merchandise may be returned within 48 hours for store credit only.

Plants are perishable after they leave the nursery, their care is beyond our control.

Pricing and availability of material are subject to change without notice. All orders accepted are subject to availability of stock on hand at the time of delivery. Prices are valid and based upon current market conditions.
WHOLESALE SALES POLICY
Any person or entity who does not follow under the following titles of landscape/lawn maintenance companies, nurserymen or active building contractors with current licenses on file is not subject to wholesale pricing and is considered a retail customer.
GUARANTEE
We guarantee all plants to be in good, healthy condition and true to name. We give no warranty, expressed or implied, as to description, quality, productiveness, or any other matter, of nursery stock we sell. We accept no responsibility for the guarantee our customers give their customers. All shipments are at the risk of the purchaser after being delivered to the customer in good condition.
RETURNS & EXCHANGES
All live goods have a 48 hour exchange policy with a receipt (some restrictions apply). All plants that are not returned at the quality level in which they were purchased will not qualify for an exchange. We do not offer returns or exchanges on plants or any live goods after 48 hours.
C&M Growers Wholesale Nursery, Inc. reserves the right to accept no returns or exchanges because plant material is a perishable good and we have no control over the way it has been handled after it leaves our possession.
SAFETY
If your clients wish to visit our facilities, they must be accompanied by you, our customer. You must escort them through the nursery and be available to answer any questions they may have.
Please do not send in your customers to look for plants without you. They will be turned away.
PAYMENT OPTIONS
All sales are on a C.O.D. basis unless credit arrangements have been made in advance. Cash, authorized business checks, debit cards, VISA, MasterCard, Discover and American Express Cards are gladly accepted. When paid by check, Buyer authorizes us to make a one-time electronic funds transfer from Buyer's account or process the payment as a check transaction. VISA, MasterCard, Discover, and American Express may be used within 15 days of invoice date with no fee. Thereafter, a 3% convenience fee shall be automatically made for all credit card payments on account recognizing that we are being charged to provide this convenience.
RETURNED CHECK POLICY
A $30.00 service charge shall be made for all checks that are returned NSF, due to the charges we incur from our banking institution.
PAST DUE ACCOUNTS
Accounts over 30 days past due or those with unpaid interest charges will revert to a strict C.O.D. basis. Accounts will be reviewed before credit can be re-established. If an account is turned over to an attorney or agency for collection, the purchaser agrees to pay all collection, attorney and court costs incurred by the Seller. C&M GROWERS…
has the right to deny replacement of any plant that fails to grow or perform to your liking due to neglect, improper handling or abuse.
is not responsible for improper planting, transplanting, pruning, watering, fertilizing, herbicide or pesticide use.
has the right to deny credit for extreme weather conditions. This includes, but is not limited to, periods of drought or water restrictions, flood, wind, rain, sleet, freezing rain, excessive or fluctuating weather, temperature and environmental extremes, salt damage, and natural disasters.
has the right to deny credit to damaged or infected plant material that we feel has the ability to recover with proper care or for plant material that lacks quantity or quality of flowers.
has the right to deny credit due to improper or untimely planting, placement of stock in the landscape, or care provided after time of purchase.
reserves the right to deny credit for any condition beyond our control after it leaves our property.
also reserves the right to delay the issue of credit until further information is deemed necessary to warrant proper replacement by staff.
NOTIFICATION OF CHANGES TO OUR STATEMENT OF POLICY
This Statement of Policy may be updated and modified from time to time by C&M Growers Wholesale Nursery, Inc. in its sole discretion. If C&M Growers Wholesale Nursery, Inc. decides to change it’s Statement of Policy or if C&M Growers Wholesale Nursery, Inc. makes any material changes in company procedures or practices, C&M Growers Wholesale Nursery, Inc. will post a notice of those changes here in its Statement of Policy.
